Draft — pending legal review. This document describes how Kinto works today but has not yet been reviewed by a lawyer. Wording may change before it is finalised.
Terms of use
The ground rules,
kept simple.
These terms apply when you use the Kinto apps, talk to Sarah, use the kinto.you website or sign in to the Kinto care workspace.
About these terms
Kinto is provided by [Legal entity name — TODO] (“Kinto”, “we”, “us”). [Company number, registered office address and ICO registration number — TODO]. By using Kinto you agree to these terms. Our privacy policy explains how we handle personal information.
If you use Kinto through a care provider, your use is also covered by that provider’s agreement with us; if the two conflict about the provider’s service, that agreement wins.
Sarah is an AI — not a medical or emergency service
In an emergency, call 999. For urgent medical advice, call NHS 111 or speak to a doctor, nurse or your care team.
- Sarah is an artificial intelligence, not a person. She can misunderstand, forget or get things wrong.
- Sarah does not give medical, legal or financial advice, and nothing she says should replace advice from a qualified professional.
- Sarah does not monitor your safety, and she cannot summon help or contact emergency services for you.
- Sarah does not replace the people who care for you. Care decisions are always made by people.
Your account
- You must be 18 or over to create an account.
- Give accurate details and keep your password private. You are responsible for activity on your account.
- Tell us straight away at support@kinto.you if you think someone else has used your account.
- You can delete your account at any time — see kinto.you/delete-account.
Care organisations
If you use the care workspace on behalf of a care provider:
- you may only access records you need for your role, and only for the care of the people concerned;
- the care provider is responsible for the accuracy of the records it keeps, for who it invites and what role they have, and for meeting its own legal and regulatory duties (for example, to the CQC);
- suggestions Kinto makes — summaries, risk scores, early-warning indicators and drafts — must be checked by a qualified person before anyone relies on them.
Acceptable use
Please do not:
- use Kinto to harm, harass or deceive anyone, or to break the law;
- try to access accounts, organisations or records you are not authorised to see;
- attempt to disrupt, overload, reverse-engineer or probe the security of the service;
- use Kinto to generate content that is unlawful, abusive or sexually explicit; or
- use automated tools to access Kinto except through interfaces we provide for that purpose.
We may suspend access that puts other people or the service at risk.
Your content
What you say and upload remains yours (or, for care records, the care provider’s). You give us permission to store and process it only to provide Kinto to you, as described in our privacy policy. Replies Sarah generates are provided for your personal use.
The service
We work hard to keep Kinto available and accurate, but we cannot promise it will always be available, uninterrupted or error-free. We may change or improve features; if we remove something important we will give reasonable notice. Some features rely on third-party providers described in our privacy policy.
Our liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud, and nothing affects your statutory rights as a consumer.
Subject to that, we are not responsible for loss caused by relying on what Sarah says instead of seeking professional or emergency help, or for losses that were not reasonably foreseeable. Legal review: liability caps for consumers and for care-provider customers.
Ending your use
You can stop using Kinto and delete your account at any time. We may suspend or close an account that breaks these terms, or if we stop offering the service, giving notice where we reasonably can.
Changes to these terms
We may update these terms. We will change the “last updated” date above and, for significant changes, tell you in the app or by email before they take effect.
Governing law
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you may also bring proceedings in your local courts.
